Terms and Conditions

1. The Promoter is: Neath Port Talbot County Borough Council of Civic Centre, Port Talbot, SA13 1PJ (the “Council”)
   
   
2. The title of the competition is: Be a Part of Our History Competition
   
   
3. The Be a Part of Our History Competition is a competition that encourages young people to create a cartoon, collage, cross-stitch, drawing, graphic-design, painting, print or pictorial map  (or any other appropriate art-form) to celebrate our heritage and show what our heritage means to them.  Entries have to be A3 Size – 297mm x 420mm in either landscape or portrait.  Entrants can use the Council’s Our Heritage Timeline for reference purposes if they so wish (see Appendix 2).   Entrants must give their creation a Name or Title. The entries will be judged and a winner will have their creation exhibited in Studio 40, 40 Queen Street, Neath for the duration of the Neath Arts & Literature Festival, taking place on 18^th to 22^nd October 2023. The winning entry will be digitalised and appear on the Neath Port Talbot County Borough Council website and on the Neath Library digitalised noticeboard.

Eligibility

4. The competition is only open to young people aged 16-25 years, who are either living, studying or working in the Neath Port Talbot County Borough Council area.
   
   
5. Entrants aged under the age of 18 must first obtain the consent of a parent or guardian before entering the competition. All entrants under the age of 18 will be required to provide the Council with the contact details of the consenting parent/guardian so that the Council may verify their consent if necessary.
   
   
6. Employees of the Council and those who have been involved in developing the Council’s Heritage Strategy in any capacity are not eligible to participate in this competition.
   
   
7. The Council will not accept competition entries that are:

• automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
• completed by third parties or in bulk;
• illegible, have been altered, reconstructed, forged or tampered with;
• photocopies and not originals; or
• Are not the stated entry size (A3)
  
  

8. There is a limit of one entry to the competition per person.
   
   
9. Joint submissions between eligible entrants will not be accepted.

How to Enter

10. The competition will run from 09.00 on 4th September 2023 (the “Opening Date”) to 17.30 on 4^th October 2023 (the “Closing Date”).
    
    
11. All competition entries must be received by the Council by no later than 17.30 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    
    
12. The competition is free to enter and no purchase is necessary to take part in this competition.
    
    
13. To enter the competition you must:

• Bring your completed cartoon, collage, cross-stitch, drawing, graphic-design, painting, print or pictorial map (or any other appropriate art-form) marked with your Postcode, Age and the name/title of your creation (on the back of your creation) to any library operated by the Council (see NPT Managed Libraries for your nearest branch). Entries have to be A3 Size – 297mm x 420mm in either landscape or portrait.  There will be a competition box within each branch where entries are to be submitted.
• Complete an Entry Form (entry forms can be printed from the NPTCBC website) and include your Age, name, postcode and an email address or telephone number. If you do not live in Neath Port Talbot but do work or study at an organisation in Neath Port Talbot, please use your relevant organisation’s postcode instead. You will also need to complete on the Entry Form a short summary of your entry including a synopsis of what inspired you to create it.
• All entrants under the age of 18 should provide their name, relevant postcode, their parent/guardian’s name, and their parent/guardian’s email address or telephone number.

14. The Council will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. Proof of transmission will not be accepted as proof of entry.
    
    
15. We may reject any entry which is incomplete, incomprehensible, illegible, defaced or using a copy of an official form. We also reserve the right to reject entries that are unlawful, racist, inflammatory, defamatory or which we consider to be otherwise harmful. We further reserve the right to disqualify any entrant who uses multiple names and/or multiple email addresses. If you use your work computer, you may need your employer’s permission before entering.
    
    
16. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

The Prize

17. There will be only one winning entry in the competition. The prize for the winning entrant is that their entry will be used for the Neath Arts & Literature Festival 2023, being displayed for the duration of the Festival – 18^th October to 22^nd October 2023. It will also appear digitally on the NPTCBC website and on the Neath Library digital noticeboard. The winner will also win a Cadw Family membership for 1 year.
    
    
18. There is no cash alternative for the prize. The prize is not negotiable or transferable. The Council reserves the right to substitute the prize with a prize of equivalent or higher value if circumstances beyond the Council’s control make it necessary to do so.
    
    
19. The winning entry may or may not also be used in further Council publicity and media as per condition 28 below.

Winner

20. The competition entries will be judged by a panel of members from the Heritage Neath Port Talbot Project Board and other representatives of the Council. The decision of the panel of judges will be final and no correspondence or discussion will be entered into.
    
    
21. We will notify the winner by email/telephone using the email/telephone number provided with the winning entry on 11^th October 2023.
    
    
22. If a winner does not respond to the Council within 2 working days of being notified by the Council, then that entrant’s prize will be forfeited and the Council reserves the right to select another winner in accordance with the process described above.
    
    
23. The Council will publish the name of the competition winner and an image of the creation on NPTCBC social media platforms immediately upon receipt of a positive response from the winner. If the winning entrant is under 18, the Council will only publish their first name. If you object to any or all of your name and/or winning entry being published or made publicly available, please contact the Council as soon as possible.
    
    

    Data Protection
    

24. The personal data supplied by entrants will be used in accordance with our Privacy Notice. You should read our Privacy Notice in addition to these terms and conditions. Our Privacy Notice can be found appended below these terms and conditions.
    
    
25. All entrants are entitled to have their details removed from our records by contacting us. If details are removed prior to the conclusion of the competition and/or award of prize the entrants will no longer participate in the competition. The Council reserves the right to publish the name of the winners as per condition 23 above.
    
    
26. All entries and personal data of entrants collected in relation to this competition will be securely destroyed immediately following successful publication of the winning entry. If you would like your entry to be returned to you, please indicate this alongside your entry when submitting.
    
    

    Intellectual Property

27. By submitting your competition entry and any accompanying material, you agree to:

• assign to the Council all your intellectual property rights with full title guarantee; and
• waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

28. You agree that the Council may, but is not required to, make your entry available on its website, on exhibition in Studio 40  Contemporary Art Centre, 40 Queen Street, Neath SA11 1DL and any other further publications, exhibitions and/or media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Council a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

Liability

29. Insofar as is permitted by law, the Council, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Council, its agents or distributors or that of their employees. Your statutory rights are not affected.

General

30. The Council reserves the right to hold, void, cancel, suspend or amend the competition at its absolute discretion.
    
    
31. The terms and conditions shall be interpreted in accordance with the Law of England and Wales.

Appendix 1

Privacy statement

1. In providing us with your personal information you hereby acknowledge that Neath Port Talbot County Borough Council is the Data Controller for all the personal information you provide (for the purpose of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA)) and you are consenting to the Council using your personal data for the purposes set out in paragraph 2 below.

As you are consenting to the Council’s use of your personal data please be advised you may withdraw your consent to this processing at any time by notifying us in writing.    

2. The personal data which we collect from you will be used by the Council (pursuant to it carrying out its various statutory and business functions) for the following purposes:

To be able to identify who has submitted entries and to be able to notify the winner.

3. As a Data Controller the Council is required under UK GDPR to inform you which of the Article 6 UK GDPR “Data Processing Conditions” it is relying upon to lawfully process your personal data. In this respect please be advised that in regards to the data provided by you we are relying on the following Article 6 condition(s);

“The data subject has given consent to the processing of his/her personal data for one or more specific purposes.”  (Article 6(1)(a) UK GDPR).

4. We will not share your personal data with any third parties (i.e. persons/bodies/entities outside the Council) unless we are required to do so by law.
   
   
5. The personal information collected from you will be held by the Council for a period of:

Until 11/10/2023 when the competition ends.

6. The Council will not transfer any of your personal data outside of the European Economic Area or other country with an adequacy decision. All processing of your personal data by us will be carried out in the United Kingdom, European Economic Area or other country with an adequacy decision.
   
   
7. The Council will not use your personal data for the purposes of automated decision making.
   
   
8. Please be advised that under UK GDPR individuals are given the following rights in regards to their personal data:

• The right of access to their personal data held by a data controller.
• The right to have inaccurate data corrected by a data controller.
• The right to have their data erased (in certain limited circumstances). 
• The right to restrict the processing of their data by a data controller (in certain limited circumstances).
• The right to object to their data being used for direct marketing.
• The right to data portability (i.e. electronic transfer of data to another data controller).

9. In the event that you have any queries regarding our use of your personal data, you wish to have access to the same or you wish to make any complaint regarding the processing of your personal data please contact the Council’s Data Protection Officer at the Chief Executives Directorate, Civic Centre, Port Talbot, SA13 1PJ.
   
   
10. Please be advised that in the event that you make a request or a complaint to the Council’s Data Protection Officer (see 9 above) and you are dissatisfied with the Council’s response you are entitled to complain directly to the Information Commissioner’s Office. Details of the Commissioner’s Office contact details and further information on your rights may be obtained from the Commissioner’s website: www.ico.org.uk.
